Refund policy

Product Return and Refund Policy

This Policy sets out the terms for the return, replacement and refund of products sold by AQUAREA LLC.

This Policy does not limit any rights granted to consumers under the applicable laws of Georgia.

1. Return of Products Purchased Remotely or Outside Business Premises

Under the applicable laws of Georgia, a consumer who purchases a product under a distance contract or a contract concluded outside business premises has the right, except in cases provided by law, to withdraw from the contract without giving any reason within 14 calendar days.

For the purchase of goods, the 14-day period begins on the day when the consumer or a third party designated by the consumer, other than the carrier, takes physical possession of the product.

If several products included in one order are delivered separately, the period begins on the day the final product is received.

To exercise the right of withdrawal, the consumer must clearly notify AQUAREA of the decision to withdraw from the contract before the 14-day period expires.

The consumer may contact us by email, telephone or another means that allows the request to be identified.

2. Returning the Product

After notifying AQUAREA of the decision to withdraw from the contract, the consumer must return the product without undue delay and no later than 7 calendar days after sending the withdrawal notice, unless AQUAREA has agreed to collect the product itself.

The direct cost of returning the product is borne by the consumer unless:

  • AQUAREA agrees to cover the return cost;

  • the consumer was not informed in advance that the return cost would be borne by the consumer;

  • otherwise provided by applicable law.

The consumer may inspect the product only to the extent necessary to determine its nature, characteristics and functionality.

If the value of the product has decreased as a result of handling or use beyond what is necessary for such inspection, the consumer may be responsible only for the corresponding reduction in value as provided by law.

Opening the product packaging does not by itself result in the loss of the right of return, except in cases expressly provided by law.

3. Refunds

If the consumer lawfully withdraws from the contract, AQUAREA will refund all payments received from the consumer, including the cost of standard delivery, where applicable.

If the consumer selected a more expensive delivery method than the standard delivery method offered by AQUAREA, AQUAREA is not required to refund the additional delivery cost.

The refund will be made without undue delay and no later than 14 calendar days after AQUAREA receives the consumer's notice of withdrawal.

The refund will be made using the same payment method used by the consumer for the original purchase unless the consumer agrees to another method and does not incur additional costs as a result.

AQUAREA may withhold the refund until:

  • the product has been returned to AQUAREA; or

  • the consumer provides evidence that the product has been sent back.

The earlier of these events will apply.

This right to withhold the refund does not apply where AQUAREA has agreed to collect the product itself.

4. Exceptions to the 14-Day Right of Withdrawal

The 14-day right to withdraw from the contract without giving a reason does not apply in cases excluded by applicable Georgian law.

Such cases may include:

  • products made to the consumer's individual specifications or clearly personalized to the consumer's personal needs;

  • perishable products or products with a short shelf life;

  • sealed products where the seal has been broken after delivery and return is not possible for health protection or hygiene reasons;

  • products that, due to their nature, have become inseparably mixed or combined with other goods after delivery;

  • other cases where the right of withdrawal is excluded by applicable law.

Opening sealed packaging excludes the 14-day right of withdrawal only where the relevant health or hygiene conditions provided by law also apply. Therefore, this rule does not automatically apply to every opened product.

The specific 14-day withdrawal rules under Georgian consumer protection legislation do not apply to goods or services priced at GEL 30 or less. This limitation does not affect the consumer's rights where a product is defective or does not conform to the contract.

5. Non-Defective Products Purchased in the Showroom

The statutory 14-day right of withdrawal applicable to distance sales does not automatically apply to a non-defective product purchased in person at the AQUAREA showroom.

The return or exchange of such a non-defective product without cause may be made by agreement between AQUAREA and the customer.

This rule does not limit the customer's rights if the product is defective or does not conform to the agreed terms of the contract.

6. Defective Products or Products That Do Not Conform to the Contract

If a product is defective or does not conform to the agreed terms of the contract, the consumer's rights apply regardless of the sales channel.

This applies both to online and other distance orders and to products purchased at the AQUAREA showroom.

Where provided by law, the consumer's primary remedies are:

  • free repair of the product; or

  • replacement of the product.

Repair or replacement must be completed within a reasonable period and without causing significant inconvenience to the consumer.

Free repair or replacement includes the necessary costs required to bring the product into conformity with the contract.

If repair or replacement is impossible, is not completed within a reasonable period or causes significant inconvenience to the consumer, the consumer may, where provided by law, request:

  • an appropriate reduction in the price; or

  • withdrawal from the contract.

If the lack of conformity is minor, the consumer may not be entitled to withdraw from the contract.

7. Time Limits for Defective Products

The consumer may exercise the rights provided by law if the defect becomes apparent within 2 years from the date the product was delivered.

If the defect becomes apparent within 6 months of delivery, it is presumed, unless proven otherwise, that the defect existed at the time of delivery, provided that such a presumption is compatible with the nature of the product and the nature of the defect.

During this period, the burden of proving otherwise rests with the trader.

If the defect becomes apparent more than 6 months after delivery, the consumer must demonstrate that the defect existed at the time of delivery.

Any commercial warranty issued by AQUAREA or the manufacturer does not limit the consumer's statutory rights.

8. Installation-Related Cases

If installation was carried out by AQUAREA or under AQUAREA's responsibility and the product's non-conformity resulted from improper installation, the matter will be treated in accordance with the rules applicable to products that do not conform to the contract.

If the issue was caused by improper installation, use, damage or failure to follow the manufacturer's instructions by the consumer or a third party, the matter will be assessed based on the specific circumstances and applicable law.

Installation of a product does not by itself cancel the consumer's statutory rights.

9. Assessment of a Possible Defect

To help assess a possible defect or damage, AQUAREA may ask the consumer to provide:

  • an order number or other proof of purchase;

  • a description of the issue;

  • photographs or video of the product;

  • the product itself for inspection where the issue cannot be assessed remotely.

Failure to provide photographs or video does not by itself cancel the consumer's rights under applicable law.

10. Orders by Legal Entities and Business Customers

The special consumer rights established under Georgian consumer protection legislation apply to persons who qualify as consumers under applicable law.

Where a product is purchased by a legal entity or by a person acting for business or professional purposes, return conditions may be governed by the relevant contract, quotation, invoice or another agreement between the parties.
